At Buffer Sounds (“we”, “us”, or “our”) we value our relationships with our artists and are committed to transparent communication about our practices and expectations. This Artist Agreement Policy outlines the terms under which you, the artist, engage with Buffer Sounds and how we work together to promote your career.

1.0 Media Usage
You grant Buffer Sounds permission to use your images and personal information for marketing purposes, including, but not limited too, digital campaigns, social media, print materials, and video content. This promotes you as an artist directly or as part of Buffer Sounds’ broader marketing strategies.
1.1 Intellectual Property Rights
You retain full ownership of your original content. Buffer Sounds is granted a license to use these materials for marketing and content as specified in this policy. Buffer Sounds will not sell or transfer rights of any materials without your explicit permission.
1.2 Media Modification & Manipulation
Buffer Sounds reserves the right to modify or manipulate the images and videos you provide. This may include, but is not limited to, background removal, retouching, and creative alterations needed for marketing purposes. When appropriate, Buffer Sounds may present any modifications or manipulations to you before they are used; however, this will be determined on a case-by-case basis.
Under no circumstances will Buffer Sounds alter images in a manner that could misrepresent or damage your reputation.
1.4 Media Removal
You can request the removal of content at any time. While Buffer Sounds will consider all requests, we retain the right to deny requests. Removal of images may take up to 31 days.
2.0 Media Captured by Buffer Sounds
Buffer Sounds may capture photos or videos of you during live gigs, events, promotional activities, or ‘backstage’.
2.1 Ownership of Media
Buffer Sounds retains ownership of all media captured by our team. You grant Buffer Sounds a non-exclusive, royalty-free license to use this media across various platforms and promotional materials, including but not limited to, social media, websites, and print media.
2.2 Artist’s Right to Use
Buffer Sounds grants you a non-exclusive, royalty-free license to use photos or videos featuring you for your own self-promotion, on websites, social media, or promotional materials.
2.3 Modification & Manipulation
Buffer Sounds reserves the same rights for modification and manipulation of captured media as outlined in section 1.2 Media Modification & Manipulation.
2.4 Removal Requests
You may request the review and removal of captured media, these requests follow the same rights as outlined in section 1.4 Media Removal.
3.0 Term and Termination
Artists may request to leave the roster at any time. Buffer Sounds reserves the right to remove an artist from the roster at our discretion. Once removed, existing social media and marketing materials featuring the artist may remain active, but no new content will be created using the artist’s likeness. The full removal process may take up to 31 days.
3.1 Duration of Agreement
This agreement is ongoing until either party decides to terminate it.
4.0 Pricing
Buffer Sounds does not charge any fees for joining our roster or for participation in standard promotional activities. Standard promotional methods include, but are not limited to, website listings, social media posts, videos, and print materials.
4.1 Gigging Fees
Fees apply only after a gig has been successfully booked. Rates are consistent across all artists, and you will receive prior notice of any changes to ensure transparency. Payment terms are arranged individually per artist or gig.
4.2 Payments Failure
In the event that a venue or event organizer fails to pay an artist (whether directly or through Buffer Sounds) for a performance secured by Buffer Sounds, we will take all reasonable steps to secure the payment on behalf of the artist. Buffer Sounds maintains a list of venues flagged for prior non-payments, and we will make artists aware of these to avoid future issues.
If an artist is paid directly by the venue or event organizer, they are required to pay the agreed booking fee to Buffer Sounds. Consistent failure to pay booking fees may lead to a review of the artist’s standing on the roster, with potential removal.
5.0 Gigging Opportunities
Buffer Sounds will make every effort to secure gigging opportunities for artists but cannot guarantee the frequency or success of bookings.
5.1 Rights of Refusal
Artists have the right to refuse any gig offered by Buffer Sounds. Gigs will always be presented for confirmation before Buffer Sounds confirms the event. Artists may decline any gig offered without penalty.
5.2 Gig Cancellations by the Artist
If an artist is unable to perform at a previously confirmed gig, Buffer Sounds requests notification at the earliest possible time to facilitate the arrangement of a suitable replacement. Repeated or frequent cancellations without timely communication may prompt a review of the artist’s standing on the roster. Consistent failure to perform as scheduled may result in removal from the Buffer Sounds roster.
6.0 Exclusivity
Artists are free to work with other agencies or seek additional representation. This agreement does not impose exclusivity unless specified in an additional agreement.
7.0 Confidentiality
Both Buffer Sounds and the Artist agree to maintain the confidentiality of sensitive information, including but not limited to trade secrets, business strategies, and financial data.

1.3 Social Media Imagery
Buffer Sounds may use content from your social media accounts within marketing materials and content, with the aim of promoting you and enhancing your visibility whether directly or indirectly.
